1. Introduction

These Terms and Conditions govern your use of the bookfluence platform and services provided at bookfluence.io. By purchasing or using any bookfluence product, you agree to be bound by these terms in full.

Bookfluence is operated by Utterly Social Ltd, a company registered in England and Wales. Throughout these terms, references to "we", "us", or "our" refer to Utterly Social Ltd, and references to "you" or "your" refer to the customer or user of our services.

2. Services

Bookfluence provides personalised book marketing strategy documents for authors. Our current products include:

  • StoryEngine - A comprehensive, personalised marketing strategy document based on your responses to our author questionnaire.
  • StoryDrive - An extended strategy and implementation guide that builds on the StoryEngine, providing additional tactical content and a structured launch plan.
  • StoryIgnite - Additional services as described on our website when available.

All strategies are generated using our proprietary framework, which combines structured questionnaire data with AI-powered content generation. Every document is reviewed by a marketing professional before delivery to ensure quality and accuracy.

3. Orders and Payment

By placing an order through our website, you are making an offer to purchase our services at the price displayed at the time of your order. All prices are displayed in British Pounds Sterling (£) and are inclusive of VAT where applicable.

Payment is required in full at the time of purchase. We accept payment methods as displayed on our checkout page. Your order is confirmed once payment has been successfully processed and you receive an order confirmation email.

We reserve the right to change our prices at any time. Any price changes will not affect orders that have already been confirmed.

4. Delivery

After your order is confirmed, you will be asked to complete our author questionnaire. Your personalised strategy document will be produced once we have received your completed questionnaire.

We aim to deliver your completed strategy within the timeframe stated on our website at the time of purchase. Delivery times are estimates and not guaranteed, though we will make every reasonable effort to meet them.

Your strategy document will be delivered electronically to the email address associated with your account or order.

5. Refund Policy

Due to the personalised and digital nature of our products, all sales are final. Once your order has been confirmed and payment processed, no refunds will be issued.

Each strategy document is individually created based on your specific questionnaire responses and cannot be resold or repurposed. For this reason, we are unable to offer refunds, exchanges, or credits once production of your strategy has commenced.

This does not affect your statutory rights as a consumer. If you believe your product is faulty or not as described, please contact us at [email protected] and we will work with you to resolve the issue.

6. Intellectual Property

Upon delivery and full payment, you are granted a non-exclusive, non-transferable licence to use your personalised strategy document for your own personal and commercial use in marketing your book.

The bookfluence brand, platform, framework, templates, methodology, and all associated intellectual property remain the property of Utterly Social Ltd. You may not reproduce, redistribute, resell, or publicly share the structure, framework, or methodology of our strategy documents.

You retain full ownership of any personal information, book details, and original content you provide to us through the questionnaire.

7. Your Responsibilities

You agree to provide accurate, complete, and truthful information when completing the author questionnaire. The quality of your strategy is directly dependent on the quality of the information you provide.

You are responsible for implementing the strategies and recommendations contained in your document. Bookfluence provides strategic guidance only and does not guarantee any specific results, sales figures, or outcomes from following our recommendations.

You must not use our services for any unlawful purpose or in any way that could damage, disable, or impair our platform.

8. Data Protection and Privacy

We take your privacy seriously. All personal data collected through our platform is processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We collect and process personal data including your name, email address, and the information you provide in your author questionnaire. This data is used solely for the purpose of creating and delivering your strategy document and communicating with you about your order.

9. Use of AI Technology

Bookfluence uses artificial intelligence as part of our strategy generation process. AI is used to analyse your questionnaire responses and generate personalised marketing content and recommendations.

Every AI-generated strategy is reviewed and quality-checked by a human marketing professional before delivery. While we take every care to ensure accuracy, AI-generated content may occasionally contain errors or suggestions that may not be suitable for your specific circumstances. You should use your own judgement when implementing any recommendations.

10. Limitation of Liability

Our strategy documents are provided as marketing guidance only. We do not guarantee any specific results, book sales, audience growth, or financial outcomes from using our strategies.

To the maximum extent permitted by law, Utterly Social Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of our services.

Our total liability to you for any claim arising from or related to our services shall not exceed the amount you paid for the specific product giving rise to the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

11. Cancellation

Under the Consumer Contracts Regulations 2013, you have a 14-day right to cancel your order from the date of purchase. However, by completing the author questionnaire and submitting it to us, you expressly consent to us beginning work on your personalised strategy before the cancellation period expires.

Once we have commenced production of your strategy document, you acknowledge that you lose your right to cancel under the Consumer Contracts Regulations 2013, as the service is bespoke and personalised to you.

12. Amendments to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website with the updated date shown at the top of this document.

Changes will not apply retrospectively to orders already placed. Your continued use of our services after any changes constitutes acceptance of the revised terms.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
